Avis Australia Rental Terms for travel between 01-Jan-2008 and 31-Mar-2009
Payment
Full payment must be made by credit card when collecting the vehicle. The credit card holder needs to be present when the vehicle is collected. When you collect your vehicle a pre-authorisation will be made on your credit card for the estimated value of the rental and any applicable security bond. Provided the vehicle is returned undamaged and no additional charges apply (e.g. fuel), the pre-authorisation is cancelled.
Avis accepts many major credit cards as credit identification at the time of rental. Debit cards, however, are not accepted as credit identification at the time of rental. Acceptable credit cards include: American Express, Diners Club, MasterCard, and Visa.
Licence Requirements
You must present a valid unrestricted Drivers Licence (i.e. not a probationary Licence) that you have held for a minimum of 12 months. The licence must include a photo of yourself.
Individuals with Learner's Permits, Provisional or Probationary licenses may not operate Avis vehicles.
Avis is unable to rent a car to anyone with a suspended, revoked, expired, canceled or surrendered driver's licence.
Driver's licenses accepted by Avis in Australia: A driver's license issued by any state or territory in Australia or New Zealand;
A driver's license issued by any United States, territory, or possession; A valid driver's license issued by a country participating in the 1949 Geneva convention on Road Traffic or the 1943 Convention on the Regulation of Inter-American Automobile Traffic. (Call the nearest reservation office for participating countries.) ; Any foreign renter must carry a driver's license written in English. Any customer carrying a non-English license must also present an International Driving Permit that is written in English; International driving permits serve only as a translation, and are valid if presented in conjunction with an official driver's license of the issuing country.
Temporary licenses:
A temporary license issued as a replacement for a lost license or due to a change of address is accepted and will be checked for validity.
A temporary license issued as a beginner's permit for the purpose of learning to drive is not accepted.
Age
The minimum age to rent an Avis vehicle is 25 except for some locations in the state of New South Wales where there is no minimum age. Exceptions may occur where due to Avis contractual agreements. In all other states, in certain situations or at certain locations, the minimum age may be 18 or 21. In all States, drivers under 25 years of age are only permitted to rent car groups X-D. In some instances a surcharge may apply for renters under age 25. Please check with Avis for details.
Underage Surcharge
The minimum age to rent an Avis vehicle is 25. Some locations may allow drivers between 21 and 25 but an underage surcharge of $27.50 per day will apply. Please note - this is a surcharge picked up by the supplier, Avis, at the time of the pick up of your vehicle. You will not be charged this surcharge until this time. Please arrange to have payment ready for this at the time of pick up of your vehicle.
Insurance
Avis provides statutory limits of liability insurance as shown on the rental agreement at time of rental. Please contact your rental location for additional information.
The renter is responsible for all damage to or theft of the Avis vehicle as described in the Avis rental agreement. For an additional fee, Avis will reduce the renter’s responsibility through the purchase of Excess Reduction at the time of rental.
In some cases, renters may be covered for loss or damage to the rental vehicle by their personal insurance or charge card. Such coverage may contain a deductible or may not be primary. Please check with your insurance company or charge card company before you rent.
Optional Excess Reduction
In Australia, Optional Excess Reduction Fee reduces the excess in most cases from $2,915 to $330. Varies by age of renter, location, type of vehicle and rate. Note: ER does not cover certain loss or damage and cannot be waived in full.
Subject to Avis Terms and Conditions of the rental agreement. Please note: This is to be paid for at the time of the pick up of your vehicle from the supplier, Avis.
Travel insurance
We strongly recommend that clients ensure they take out the highest level of travel insurance. In many cases this will cover any losses incurred if you are forced to cancel your booking.
Vehicle Type
Vehicles displayed are for demonstration purposes only. Brands and models may vary by location. Vehicles are subject to availability at time of rental.
Optional GPS Unit
Avis holds your request with your reservation. GPS Unit is available at selected locations. Please note: GPS Units are subject to availability. This item is normally available to our customers except at peak periods. Please check with the Avis contact number provided at the time of confirmation of your request.
Area of use Restrictions
Restrictions may apply if you intend to take the vehicle outside the local area in which it is being collected. If you intend to do so, you must contact the pick up location prior to the rental for advice on availability or restrictions that may apply for this rental. In Western Australia and the Northern Territory the use of vehicles in certain areas is restricted. Vehicles are not to be taken off the Mainland of Australia unless connected by bridge (for example, travel between Brisbane and Stradbroke Island or Melbourne and Devonport is prohibited).
During the ski season, vehicles may not be taken above the snowline. Please contact your selected branch for further information. Local driving conditions and restrictions vary between locations. We suggest you contact the pick up location for advice if you intend travelling outside the local area.
Off Road Driving
Avis vehicles may not be operated on non-paved roads. Driving of vehicle on beaches is not permitted. Vehicles are not allowed to be taken onto ferries or cross bodies of water.
Additional Charges
In Australia, GST, Administration Fees and Airport Concession Recovery Fees apply to optional coverage’s, one way fees and any other miscellaneous charges (e.g. re-fuelling charges or late return fees). Any additional miscellaneous charges will incur these additional taxes. Airport Concession Recovery fees are charged at most Major Airport Locations.
Kilometre Inclusions
Avis will display the kilometre inclusions on the vehicle search results and at the top of the booking window during the booking process. This inclusion varies from vehicle to vehicle and in different locations.
Minimum Rental
A minimum charge of one day applies to rentals of less than 24 hours. For other rates, specific minimum rental periods may apply. In some cases, the minimum rental may be a specified period of time for the selected rate to apply. In other cases, a rate may have a minimum charge, which applies even if the car is returned early.
Fuel
Avis rates do not include fuel. Avis offers three options for fuel in Australia:
Return the car with the same amount of fuel as when rented and no refuelling fees will apply
Return the car with less fuel than when rented and pay a refuelling service charge for the fuel used (the refuelling service charge is a rate generally higher than the local retail gasoline prices)
Purchase the fuel service option available at most Australian rental locations and participating licensees where permitted
The refuelling service option allows the renter the option of purchasing, at the time of rental, a full tank of fuel at a price competitive with the prevailing local self-service gas station rates for regular unleaded gasoline. This eliminates the need to refill the tank before the car is returned. There is no credit given for fuel remaining in the vehicle at the time the vehicle is returned so the renter should return the car with as little fuel remaining as possible.
The fuel purchase option must be selected at the time the vehicle is rented.
Rental Extensions
Cars are due back at the date/time specified on the rental agreement. If you need to extend your rental you must call the rental location directly. The location’s phone number appears on your rental agreement.
Late Arrivals
Most Avis airport locations will remain open to meet incoming customers with advance reservations but who have encountered flight delays. It is Avis policy to honor a reservation up to 16 hours beyond the stated pickup time in the event a customer is delayed.
Late Charges
Most Avis rentals are based on a 24 hour day. A car rented at 10AM for a one-day rental is due back at 10AM the next day. There is a 59-minute grace period. If the car is returned within the 59-minute grace period there will not be any additional hourly rate. Beyond the 59-minute period, an hourly rate will apply until it equals the rate for an additional day. Charges for optional services such as Excess Reduction, etc. are charged as full days after the 59-minute grace period. If a vehicle is returned beyond the parameter associated with a specific rate code the rental may revert to a higher applicable rate.
Flight Detail
Please provide flight details in the reservation. If customers are picking the vehicle up from an airport, and the flight is delayed we will be aware of this if we have the flight number.
Upgrades
A renter receives a car group higher than the one reserved. Avis guarantees the reserved car group. If it is not available at time of rental a higher car group will be substituted at the confirmed rate.
One Way Rentals
Avis offers convenient one way rentals at attractive rates.
GST
Rental charges are subject to the GST in Australia, which is 10% of the total rental charges.
Additional Drivers
No surcharge for additional driver, who meets requirements
The following individuals, if 25 years of age or older and in possession of a valid driver’s licence may drive the car with the renter’s prior permission:
Renter’s employer (while on company business)
Renter’s fellow employee (while on company business)
Renter’s spouse or life partner
The above additional drivers are considered “authorised drivers” and need not be present at the time of rental nor do they need to sign an additional driver form. Other individuals may be listed as additional drivers provided they are at least 25 years of age; present a valid driver’s licence and complete an additional driver form.
Parking Tickets, Traffic Violations
Parking tickets are the responsibility of the renter.
Emergency Road Service
In the unlikely event your car won’t start, Avis provides 24 hour a day roadside assistance.
Lost and Found
If you should leave any personal possessions in an Avis vehicle contact the returned location so that we may help you locate your belongings.
Maps and Driving Directions
Avis offers street directories and strip maps for all capital and major cities in Australia.
Parking
Unfortunately Avis is unable to provide parking for customers’ personal vehicles while they have cars on rent.
Child Safety Seats
Avis has child safety seats for infants and toddlers at most Avis locations in Australia. Failure to return the seat in the same condition as received minus normal wear and tear may result in a (AUD) $ 55.00 additional charge including GST. Fees for child safety seats may vary by rental location. Please note: Child Safety Seats are subject to availability. This item is normally available to our customers except at peak periods. Please check with the Avis contact number provided at the time of confirmation of your request. Avis has child safety seats for infants and toddlers at most Avis locations in Australia. There is a (AUD) $ 5.50 per day charge, up to a maximum of (AUD) $ 55.00 per seat, per rental. Failure to return the seat in the same condition as received minus normal wear and tear may result in a (AUD) $ 55.00 additional charge. Fees for child safety seats may vary by rental location. An airport fee (where applicable) and other administration charges will apply to the rate on this optional extra. These surcharges will be payable at the time of pick up.
Important tips for traveling in a car with your children:
1. Always use proper child safety seats:
Statistics show that children who are not properly protected face serious risk in the event of an accident, sudden stop or sudden swerving to avoid road debris or other vehicles.
2. Do not hold a child in your lap:
It is never safe to ride with the infant or child in your lap. Children are not properly protected unless securely placed in an appropriate-sized child restraint.
3. Children should always ride in the back seat in vehicles equipped with front airbags:
Children age 12 and under should always be properly restrained in the back seat. This is especially important if the vehicle has front air bags. In a crash, children can be injured or killed by an inflating air bag.
Accidents & Injuries
In the event of an accident, contact the renting location as noted on the rental agreement document or call Avis Emergency Road Service for assistance.
All accidents involving bodily injury must be reported to the local police department where the accident occurred. The driver is required to complete and file an Avis accident report. In addition, the driver must complete and file any accident reports required by local or state authorities.
Key Tags
Attached to the key ring of each set of Avis car keys is a plastic tag containing the toll free number for Avis Roadside Assistance as well as the car number, car description and license plate number. Please have this information handy if you need to call for assistance.
Non-Smoking Cars
Avis offers non-smoking cars.
Seat Belts
All states have mandatory seat belt laws. Avis encourages all drivers and passengers to always wear their seat belts.
Tow Bar
Tow bars (or trailer hitches) may not be used with any Avis vehicle.
Van Seat Removal
There are a number of customers who have special needs or health situations that require specific equipment rental arrangements. Avis will attempt to accommodate health situations whenever possible. An example might be a renter with arthritis who wants power seats. If the car is available, Avis will notify the location in advance of the special need. Sometimes, disabled renters travel with a stowaway. The stowaway is a customer-supplied device used to exit/enter the van. Customers may request for an authorized van seat removal to accommodate this device or to allow enough space for a non-collapsible wheelchair like a scooter. Removal of the seats of a van is only permitted for a medical need. Removal of seats is otherwise not permitted.
Use Of The Vehicle
(a) not allow the Vehicle to be used for any illegal purpose, race, contest or performance test of any kind;
(b) not allow the Vehicle to be used to tow or push anything;
(c) not carry more passengers than may be properly accommodated by the seat belt restraints provided in the Vehicle, or carry a greater load than that for which it was built;
(d) not be under the influence of alcohol, drugs or have a blood alcohol content that exceeds the legal limit in the State or Territory in which the Vehicle is driven;
(e) not allow the Vehicle to be used to carry passengers for payment of any kind;
(f) not use the Vehicle when it is damaged or unsafe;
(g) not use the Vehicle to transport goods, except in compliance with all necessary approvals, permits, licences and government requirements (to be obtained at Your cost) and in accordance with the Vehicle manufacturer's and Avis' recommendations;
(h) not, without Avis' prior written consent, use the Vehicle to carry any flammable substance which has a flash point under 22.8°C or any other explosive or corrosive substances; and
(i) not use the Vehicle in contravention of any law.
Return Of Vehicle
(a) to the place, on the date and by the time shown on the Rental Document;
(b) in the same condition as it was at the commencement of the Rental Period, fair wear and tear excepted.
(c)If You return the Vehicle to a location other than that shown on the Rental Document, a "one-way fee" of up to $2.00 per kilometer (depending on the nature of the Vehicle and the distance involved) may apply. If a "one-way" fee applies, You must pay it at the end of the Rental Period.
(d) You must return the Vehicle to an Avis location during normal business hours. If You return the Vehicle later than the time shown on the Rental Document, You must pay all additional rental charges.
(e) If You return the Vehicle on a date, or at a time, or to a place other than that shown on the Rental Document; or any special conditions set out in the "Rates" section on the Rental Document are breached, the rates shown on the Rental Document will not apply and You must pay the Avis standard rate for the Vehicle for the Rental Period.
(f) Avis may request the immediate return of the Vehicle, or Avis may re-take the Vehicle without notice, if Avis reasonably suspects that:
1. You have breached a term or condition of the Rental Agreement;
2. damage to the Vehicle, or injury to persons or property is likely to occur; or
3. the Vehicle will be involved in an industrial dispute; and You must also pay Avis any cost it incurs as well as all costs and charges under the Rental Agreement for the period up to return/repossession of the Vehicle.

Our total liability to you in relation to your use of this website and the information contained on this website will not exceed the dollar amount of the deposit we have received from you in relation to your booking/rental. Refunds will not be made for bookings cancelled due to inclement weather. Again, we strongly recommend that you take out travel insurance. Your use of this website is governed by the laws of New Zealand and the jurisdiction of the New Zealand courts.

Vehicle capacity and fitness to drive
Under no circumstances are you permitted to carry more passengers than the vehicle you rent is legally registered to carry, and if you do your insurance may be invalidated. The number of seatbelts (and passengers) is indicated next to each vehicle on this website. Luggage capacity where shown is an indication only and we will not be responsible should you be unable to fit your entire luggage into a vehicle. It is your responsibility to choose a journey that is within your capabilities. A vehicle supplier can refuse to rent a vehicle to any person who is in their opinion unfit to drive or does not meet eligibility requirements. In such circumstances we will have no further liability to you.
